Terms and Conditions for Buckrate Technology Private Limited

Welcome to Buckrate Technology Private Limited (“Buckrate,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of our online platform, including the website, mobile application, and any associated services (collectively, the “Platform”). By accessing or using our Platform, you agree to comply with and be bound by these Terms.

1. Acceptance of Terms

By using the Platform, you affirm that you are at least 18 years old or the age of majority in your jurisdiction. If you do not agree to these Terms, you must not use the Platform.

2. Services Provided

Buckrate provides a B2B online marketplace connecting goat farmers (“Farmers”) and meat businesses. The Platform includes an AI-powered buck price calculator to ensure price transparency. Buckrate does not guarantee the quality, health, or condition of the goods & services traded.

3. User Responsibilities

3.1 Registration:

  • You must create an account to use the Platform.
  • You agree to provide accurate and complete information during registration and keep it updated.

3.2 Compliance:

  • Users must comply with all applicable laws and regulations.
  • Any misuse or fraudulent activity is strictly prohibited.

3.3 Responsibility for Transactions:

  • You are solely responsible for verifying the quality and condition of goats before completing a transaction.
  • Buckrate is not a party to transactions between Farmers and Traders and does not guarantee payment or delivery.

4. Payment and Subscription Policy

At Buckrate, we are committed to ensuring a seamless and transparent transaction process for meat businesses, while protecting the interests of both farmers and businesses. The following policy outlines the terms for payments, cancellations, subscriptions, and other related charges on our platform.

4.1 Service Charges

  • A flat service fee will be charged for sharing farmers availability and location details with businesses.
  • This service charge is non-refundable.

4.2 Subscription Plans

  • Business can choose from annual subscription plans to enjoy:
    • Reduced per-transaction service charges.
    • Access to market analytics, mandi rates, and other premium insights.
  • Subscription fees are non-refundable.

4.3 Cancellation Policy

  • If either party (farmer or businesses) misuse the platform, a penalty will be imposed, and the account can be deactivated.
  • The penalty amount will be shared with the affected party (farmer or businesses) as compensation.
  • Cancellation penalties are non-refundable.

4.4 Delay Charges

  • Businesses are required to provide their goods and services within the agreed time frame.
  • A delay charge on daily basis will apply for delay in their committed their services.

4.5 Verified Lead Service

  • For Businesses seeking additional assurance, Buckrate offers a verified Lead service.
  • A charge will apply for Lead verification conducted by Buckrate’s partners.
  • Verified Lead charges are non-refundable.

4.6 Refund Policy

  • Service charges are non-refundable.

4.7 Payment Confirmation

  • Payment receipts and confirmations will be sent via email and/or SMS for all transactions.
  • For assistance with payment errors, please contact our support team.

5. Limitations of Liability

  • Buckrate is not responsible for any losses, damages, or claims arising from transactions conducted through the Platform.
  • The AI-powered buck price calculator provides estimated prices based on physical attributes but does not guarantee market value.

6. Prohibited Activities

Users agree not to:

  • Provide false or misleading information.
  • Use the Platform for any illegal or unauthorized purposes.
  • Attempt to disrupt or compromise the Platform’s security.
  • Trade of endangered species which includes plants, animals, or other organisms (including product derivatives) in danger of extinction

7. Intellectual Property

All content on the Platform, including text, graphics, logos, and software, is the property of Buckrate and protected by intellectual property laws. Unauthorized use is prohibited.

8. Privacy Policy

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

9. Dispute Resolution

9.1 Informal Resolution:

  • Parties are encouraged to resolve disputes amicably through negotiation.

9.2 Arbitration:

  • If a dispute cannot be resolved informally, it will be referred to binding arbitration under the Arbitration and Conciliation Act, 1996.
  • The seat of arbitration shall be Jaipur, Rajasthan, and proceedings will be conducted in English.

10. Modification of Terms

Buckrate reserves the right to modify these Terms at any time. Changes will be effective upon posting on the Platform. Continued use of the Platform constitutes acceptance of the revised Terms.

11. Termination

We may suspend or terminate your access to the Platform for any violation of these Terms or for other reasons at our sole discretion.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles.
